Terms of Use
1. Acceptance of Terms
By creating an account or using Jamverse, you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use Jamverse.
These Terms, together with our Privacy Policy, form the complete agreement between you and Jamverse regarding your use of the Service.
2. Eligibility
Jamverse is open to users of all ages. However, the following age-related requirements apply:
- Users under 13 (United States) — in accordance with the Children's Online Privacy Protection Act (COPPA), users under the age of 13 in the United States must obtain verifiable parental consent before creating an account or using Jamverse
- Users under 16 (EU/EEA) — under GDPR Article 8, users under the age of 16 in the European Union or European Economic Area must obtain parental or guardian consent before using the Service
Parents and legal guardians who consent to a minor's use of Jamverse assume full responsibility for that minor's activity on the Service, including any content created, purchases made, and compliance with these Terms.
3. Account Registration
To use Jamverse, you must create an account. When registering, you agree to the following:
- One account per person — each individual may maintain only one Jamverse account
- Accurate information — you must provide a valid and accurate email address during registration
- Account security — you are responsible for maintaining the confidentiality and security of your account credentials. You should not share your login details with anyone
- Unauthorized access — you must notify us immediately if you become aware of any unauthorized access to or use of your account
You are solely responsible for all activity that occurs under your account.
4. Service Description
Jamverse is a music creation and jamming application for macOS. The Service provides tools and features designed to help musicians create, practice, and explore music.
Features may change, be added, or be removed at our discretion as we continue to develop and improve the platform. We do not guarantee uninterrupted or error-free availability of the Service.
5. Subscription Tiers
Jamverse offers the following subscription tiers. All prices are displayed dynamically at the time of purchase — no prices are hardcoded in these Terms.
Free
The Free tier provides limited daily usage. The specific daily limit is determined by Jamverse and displayed within the application. Usage resets daily. The daily usage limit is subject to change at any time.
Pro Monthly
The Pro tier provides unlimited usage for a recurring monthly subscription fee. The price is displayed at the time of checkout. Your subscription auto-renews each month until cancelled. In the event of a payment failure, a 7-day grace period is provided before your access is restricted to the Free tier.
Founding Jammer
The Founding Jammer tier is a one-time payment that grants lifetime unlimited access to Jamverse. Founding Jammer slots are limited in number. Once you purchase a Founding Jammer slot, your lifetime access is permanent and guaranteed regardless of any future pricing changes to the platform. The purchase price for new Founding Jammer slots may change at any time without notice.
6. Pricing and Payment
- Dynamic pricing — all prices are displayed dynamically at the time of purchase in the currency shown. No prices are hardcoded in these Terms
- Payment processor — all payments are processed by Stripe. By making a purchase, you also agree to Stripe's terms of service
- No hidden fees — the price displayed at checkout is the price you will be charged
Pro Price Changes
We reserve the right to change the Pro monthly subscription price. You will receive at least 30 days notice via email before any price increase takes effect. If you do not agree with the new price, you may cancel your subscription before the new price takes effect.
Founding Jammer Price Changes
The price for new Founding Jammer slots may change at any time without notice. This does not affect existing Founding Jammers — your lifetime access is guaranteed regardless of future price changes.
7. Cancellation and Refunds
Pro Subscriptions
Pro subscriptions may be cancelled at any time through the billing portal. Upon cancellation, your Pro access continues until the end of the current paid billing period. No further charges will be made after cancellation.
Founding Jammer Purchases
Founding Jammer purchases are non-refundable, except where required by applicable law. For example, under EU consumer protection law, you may have a 14-day withdrawal right for digital goods, which may be waived upon immediate access with your consent.
Refund Requests
For refund requests, please contact us at the email address provided in Section 18 below. We may issue refunds at our sole discretion.
8. Intellectual Property
Your Content
You retain full ownership of all music, audio, recordings, and creative content you create using Jamverse. We claim no rights to your creative work.
Our Platform
The Jamverse software, design, source code, trademarks, branding, and all related intellectual property belong to Jamverse. You may not copy, reverse-engineer, decompile, or redistribute the application or any part thereof.
License to Use
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Jamverse application for personal and commercial music creation purposes, subject to these Terms. This license does not grant you ownership of the software or any rights beyond those explicitly stated in these Terms.
9. User Conduct
By using Jamverse, you agree not to:
- Reverse-engineer, decompile, disassemble, or attempt to derive the source code of the software
- Circumvent usage limits, security measures, or access controls
- Use the service to violate any applicable law or regulation
- Share your account credentials with others
- Attempt to disrupt, overload, or interfere with the service or its infrastructure
- Use automated tools or scripts to access the service
- Redistribute, sublicense, or resell access to the service
Violation of these rules may result in suspension or termination of your account as described in Section 13 below.
10. Future Collaboration Features
Jamverse may introduce collaboration features in the future that allow users to share content and collaborate on music with other users. When these features become available, additional terms may apply, including but not limited to:
- Content ownership in collaborative works
- DMCA / copyright takedown procedures
- User content moderation policies
- Community conduct guidelines
These additional terms will be communicated to you before the collaboration features launch. Your use of collaboration features will be subject to both these Terms and any supplemental collaboration terms.
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, JAMVERSE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO JAMVERSE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
13. Termination
By Jamverse
We may suspend or terminate your account if you violate these Terms. We will make reasonable efforts to notify you of such action, unless prohibited by law or where immediate action is necessary to protect the Service or other users.
By You
You may delete your account at any time by contacting us at the email address provided in Section 18 below.
Effect of Termination
- Pro subscriptions — will be cancelled with no further charges
- Founding Jammer — lifetime access is forfeited if your account is terminated for cause (violation of these Terms)
The following sections survive termination of these Terms: Intellectual Property (Section 8), Disclaimer of Warranties (Section 11), Limitation of Liability (Section 12), and Governing Law (Section 15).
14. Changes to Terms
We may modify these Terms from time to time. When we make material changes:
- You will be notified via email or in-app notification with at least 14 days notice before the effective date of the changes
- The "Effective Date" and version number at the top of this page will be updated
- Your continued use of Jamverse after the effective date constitutes acceptance of the modified Terms
If you disagree with the changes, you may close your account before the effective date. We encourage you to review these Terms periodically.
15. Governing Law
These Terms shall be governed by and construed in accordance with applicable law.
Note: The specific governing jurisdiction will be updated upon formal incorporation of the Jamverse legal entity.
16. Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms shall remain in full force and effect.
17. Entire Agreement
These Terms of Use, together with our Privacy Policy, constitute the entire agreement between you and Jamverse regarding your use of the Service and supersede all prior agreements, understandings, and communications, whether written or oral, relating to the subject matter herein.
